I have acted as a Responsible Individual for the past 10 years
for mortgage companies which desire to be licensed in Arizona.
My credentials and experience have been approved by the Arizona
Department of Financial Institutions to act as a Responsible Individual
and the Department has also issued a mortgage broker license to
me. I am also licensed in Arizona as an attorney and real
estate broker.
The law requires that the Responsible Individual be in "active
management" of the licensee, be knowledgeable about the licensee's
operations and be given sufficient authority to "supervise
compliance" with Arizona statutes and regulations. It
is essential that your Responsible Individual possess the education
and expertise to read and interpret statutes and regulations as
well as the ability to evaluate if you are complying with them.
It is also essential that your Responsible Individual has the
capability to understand the business and financial aspects of
your operations and the sophistication and experience to communicate
and work effectively with the Arizona Department of Financial
Institutions particularly during the examination process.
The Responsible Individual must be present and participate in
examinations and be able to answer questions about your business.
When the Department wants to communicate with you, often it contacts
only the Responsible Individual. Therefore, the Responsible
Individual is your liaison and representative with the Department.
Notices of examination, notices concerning renewal applications
and other important matters are sent to the Responsible Individual.
I have been licensed as an attorney for 20 years and have acted
as a Responsible Individual for the past 10 years during which
time I have handled many examinations by the Department on behalf
of licensees. From this experience, I have gleaned information
concerning the Department's interpretations of various laws and
positions on various issues which can greatly assist licensees
in complying with the law. I will provide you with written
materials concerning the Arizona statutes and regulations and
the Department's positions regarding them. I will also be
readily available to discuss compliance issues with you by email
or telephone and to answer any questions you may have. It
is my goal to maintain a stream of constant communication with
you so that you will remain in compliance with applicable Arizona
laws and rules.

"Brick and Mortar" Requirement
Arizona
is a "brick and mortar" state; that is, there is a statutory
requirement for a licensee to maintain a "principal place
of business" in Arizona. I can also assist your company with
this requirement. My office is located in Fountain Hills, a suburb
of Phoenix just east of Scottsdale.
